Christopher Joslin - Will dated, January 18, 1858 John JoslinHerkimer County, NY Surrogates Office Probate Date 12/19/1811 Letters Recorded Book - B, Page - 231 Submitted by Earl E. Joslin Jr. The last Will and Testament of John Joslin of Frankfort, in the State of New York. Calling to mind the mortality of my body and firmly believing it is appointed unto all men once to die & after that no judgment do make, I ordain this instrument in writing to be my last Will and Testament (that is) first I commit my soul into the hands of God Almighty keeping who gave it me and my body to the earth to be decently intered (sic) therein at the discretion of my Executor, herein after named, in a Christian like manner. And as touching such worldly estate as it hath pleased God in this life to bless me with, I give and dispose of the same in the following manner. In premises beginning at a hemlock studdette marker which is the Southwesterly corner of land belonging to Jacob C. Folts, thence running to George Joslins land, thence by George Joslins line till it makes fifty-five acres of land to run along the lot of land I bought of Stephen Dow on a parallel line. Item: I give unto my Grandson John Joslin, the son of David Joslin dec., twenty-five acres of land of the north side of the above fifty-five acres. Item: I give unto my Grandson Robert Joslin, the son of David Joslin dec., fifteen acres of land of the remainder of the above fifty-five acres to run a parallel line with the other lines. Item: I give to Joanna Curtis, daughter of my son David Joslin dec., five acres of land out of the above fifty-five acres, lines parallel with the first. Item. I give likewise to my Granddaughter Amy Joslin five acres out of the above fifty-five acres, lines same as above. Item: I give unto my Granddaughter Maria Joslin five acres which is the remainder of the above described fifty-five acres of land. The above gifts is to them & their heirs & asigns (sic) forever. Item: To my loving wife Content Joslin, I give the Southeast corner room, a privilege in the chamber & bathry (sic) & cellar, together with one half of my improvement land with the privilege of cutting firewood and fencing timber. This gift is to my wife instead of her right of dowry during her natural life. The land to my wife to be divided according to quality and quantity with all the household furniture together with one cow, likewise a sufficient supply of meat and grain till such time as enough can be raised. Item: I give unto my two daughters, Amy and Isabel Joslin, the remainder of my lands I have not otherwise disposed of together with one cow for the benefit of the two sisters during their lives. Then to my son Rufus I give all my wearing apparel. Then I give to my son Andrew Joslin one dollar To my son Sylvester Joslin one dollar. To my son John Joslin one dollar. Item: I give to my Grandson Henry Joslin, son of my son Henry Joslin dec., five dollars. Item: I give to my Daughter Joanna Rathbun one cow. I give to my Grandson John Joslin, son of David Joslin dec., my mare saddle and bridle with his paying Joanna Rathbun the cow I named to her. Item: I give unto my son Christopher Joslin the land that I have set off to my wife and two daughters Amy Joslin and Isabel Joslin together with the buildings thereon, of their decease, to him his heirs and asigns (sic) forever with all my personal property which he takes and Christopher Joslin paying the above requests at a reasonable time and the debts that I acrue (sic) with my funeral expenses. And lastly I do hereby nominate and appoint my son Christopher Joslin whole and sole executor of my last will and testament and hereby order the same fulfilled according to the true intent and meaning of this my last will and testament utterly revoking all the wills gifts or bequests heretofore made by me. The foregoing is a true copy of an instrument purporting to be the last will and testament of John Joslin late of Frankfort Herkimer County deceased. I Sylvester Joslin of the Town of Frankfort & County of Herkimer & State of New York do ordain this instrument to be my Last Will and Testament oy (sic). Item: I give unto my loving wife Hannah Joslin the great room, in and northeast bedroom a privilege in the chamber and bathery (sic) and in the cellar, and one cow to be kept winter and summer, fire wood to be delivered to the house and outfit for the farm with a sufficient quantity of grain for her support as long as she remains my widow, with all the household furniture. That all my debts and funeral charges be punctually paid by my executors hereafter named. Item: I give to my daughter Hannah Budlong one set of Callico (sic) Curtains one set of Winsor (sic) chairs and one Bible. My will is that my heirs that are under twenty-one years of age, Sylvester Joslin, Benedict Joslin, John Joslin, Christopher Joslin, Hiram Joslin shall be educated and clothed out of my estate to common becoming and their labor for the benefit of the estate till each one shall arrive to the age of twenty-one years. My will is that what remains of my estate, real and personal, when my youngest child shall arrive at the age of twenty-one years, shall be equally divided amongst them except my daughter Hannah Budlong above named which has had her share of my estate and lastly I nominate my wife Hannah Joslin and my son Andrew Joslin and Christopher Joslin executors of this my last Will and Testament wholly revoking all others, in witness whereof I have here unto set my hand and seal this fourteenth day of April in the year of our Lord 1813. I Robert Joslin of the town of Frankfort and County of Herkimer, State of New York considering the uncertainty of this mortal life but being of perfect mind and mind (sic) and memory, Blessed be God Almighty for the time to make & publish this my Last Will & Testament in manner and form following. That is to say, as I have a legacy bequest to me by my grandfather John Joslin, that is to say, part of a lot of land situated in the town of Frankfort, County of Herkimer & State of New York containing fifteen acres in lot no. one hundred and ten in Freemans Patent. Firstly I authorize John Joslins (symbol for executor) Christopher Joslin to dispose of the above named fifteen acres of land to the best advantage for the discharge of my debts, and the residue of the money I give to my beloved wife Rachel Joslin together with all the personal property that will be left at my decease. Secondly I appoint John Joslins (symbol for executor) Christopher Joslin my executor of my Last Will & Testament hereby revoking all former wills by me made. In witness whereof I have here unto set my hand and seal the fifteenth of September in the year of our Lord one thousand eight hundred & nineteen. Probate Date 2/28/1859 Submitted by Earl E. Joslin Jr. Be it remembered that heretofore, towit on the 14th. Day of January, 1859, Lewis F. Joslin a son and executor named in the last will and testament of Christopher Joslin, late of the town of Frankfort deceased, appeared in open court before the surrogate of the County of Herkimer and made application to have the said last will and testament, which relates to both real and personal estate proved and on such application the surrogate did ascertain by satisfactory evidence they were the heirs and next of kin of the said testator and their respective residences and some of them appearing to be minors and having no general guardian within the State of NY, a special guardian was appointed in due form of law to take care of their interest in the matter of proving the said will, by an order entered for that purpose by said surrogate: and said surrogate did thereupon issue a citation, in due form of law directive, to the said heirs and next of kin and special guardian by their respective names stating their respective places of residences, requiring them to appear before said surrogate at his office in the village of Herkimer on the 28th. Day of February, then next to attend the probate of the said will. And afterwards, towit on the said 28th. of February, satisfactory evidence by affidavit was produced & presented to said surrogate of the sense of the said citation in the mode presented by law and no one appearing to oppose the probate of such will, such proceedings were thereupon had that the surrogate took the proof of said will, hereinafter reported, and he adjudged the said will to be a valid will of real and personal estate & the proofs thereof to be sufficient which said last will & testament therefore are approved. That is to say. WILL In the name of God Amen. I Christopher Joslin of the town of Frankfort in the County of Herkimer & State of New York, being of sound mind and memory, do make publish and declare this my last will and testament in manner following, that is to say. First - I order and direct that all my bills and funeral expenses be paid, that suitable tombstones be purchased by my executors and erected at my grave. Second - I give and devise unto my two daughters, Johanna A. and Margaret A. Joslin of the town of Frankfort, all my real and personal estate of every name and nature whatever to be equally divided between them share and share alike. Third - I give and devise unto Mary Joslin, my daughter, now in the state of Michigan, the sum of one hundred and fifty dollars be paid by my said daughters Johanna A. & Margaret A. Joslin within one year after my decease and to be a charge on my said estate. Fifth - I give and devise unto my grandchildren and children of my daughter Almira Brayton now deceased viz William L. F. Brayton, Betsy Ann Hersey wife of Lewis Hersey, Mary Sathrop, and Abigail Pratt wife of Henry Pratt, all of the State of Iowa, the sum of six dollars & twenty-five cents each ($6.25,) to be paid to each of them by my said daughters Johanna A. & Margaret A. Joslin within one year after my decease and to be a charge on my estate Sixth - And lastly I constitute and appoint my son Lewis F. Joslin and my son-in-law Jordan Joslin, executors of this my last will and testament hereby revoking all former wills by me made. In witness I have hereto set my hand and seal this 18th. Day of January 1858. his Christopher X Joslin (his seal) mark The above instrument consisting of a half sheet of paper, made at the date thereof, signed sealed and published and declared by the said Christopher Joslin of and for his last will and testament in presence of we who at his request and in his presence and in the presence of each other, have subscribed our names as witnesses thereto. Ely F. Marsh residing in Frankfort, Herkimer Co., NY Samuel Z. Hoard in Frankfort, Herkimer Co., NY Herkimer County P Ely F. Marsh of the town of Frankfort in the County of Herkimer and Samuel Z. Hoard of the town of Frankfort in the County of Herkimer, being first duly sworn in open court on their oaths, do depose and say that they are subscribing witnesses to the last will and testament of Christopher Joslin late of the town of Frankfort in the said County of Herkimer, deceased. And these deponents further say that the said deceased did, in the presence of these deponents, subscribe his name at the end of the instrument which is now shown to these deponents and which proports to be the last will and testament of the said deceased and which bears date of the 18th day of January A.D. 1858. That the said deceased did at the same time of proscribing his name on the instrument aforesaid, declare the same to be his last will and testament. That these deponents did thereupon proscribe their names at the end of said instrument as attesting witnesses. In the execution thereof at the request of the said deceased and in his presence and in the presence of each other. That the said deceased at the time of subscribing his name to said instrument, as aforesaid, was upwards of twenty-one years of age, that he appeared to be of sound mind and memory and was not under restraint to the knowledge or belief of these deponents. Joslin Jr. I Gaylord Joslin of the town of Litchfield in the County of Herkimer and State of New York, being of sound and dispsing (sic) mind & memory do make publish and declare this my last will and testament in manner following that is to say. First - I order and direct that all my just debts and funeral expenses shall be paid and suitable grave stones be erected at my grave and the grave of my wife, out of my estate, as soon after her and my decease as the same can properly be done. Second - I give and bequeath to my son Thomas K. Joslin, the sum of one dollar to be paid to him as soon after my decease as the same can be properly be paid. Third - I give and bequeath to my beloved wife Phebe Joslin the use of all my real estate and the use of all my personal estate except the one dollar to (sic) paid to Thomas. To have and use the said real and personal estate so long as she shall remain my widow in lieu of her dower. She however during the time she so has the use thereof is to keep the same in proper repairs, and use and occupy the same in a proper manner. Fourth - I devise give and bequeath to my son Ezra P. Joslin, all my real estate and all the rest and residue of my personal estate after the payments of my debts, funeral expenses and above mentioned legacy subject however to the use thereof by wife during her life as afore said. He my said son Ezra to take the possession thereof as absolute owner thereof after the termination of the estate of my wife therein as aforesaid. The real estate intended to be embraced in the above devide (sic) to my said son Ezra is the same house and farm in which I now reside, situate in the town of Litchfield aforesaid and bounded northerly by land of Samuel H. Kinne, Easterly by lands of Alonzo Avery, southerly & southwesterly by lands of Loran D. Elsworth, and also that certain piece of ledge (sic) or ___sry (sic) situate in the town of Frankfort containing about one quarter of an acre of land, more or less, and bounded northerly by Jedediah Tillinghast and easterly by lands easterly by lands of George D. Joslin, westerly by lands of Sanford Joslin and southerly by a highway leading from Frankfort to Crane Corners. It is my intention and I expressly, declare this my will to be that during my life. If I should dispose of any of the said real estate, and should purchase or become the owner of any other real estate, then the said lands purchased and owned by me, wherever the same may be, shall go to my said wife to use so long as she shall remain my widow, and after that to my said son Ezra in fee as above mentioned. And lastly I hereby nominate and appoint my wife Phebe and my said son Ezra, aforesaid, my executors to this my last will and testament hereby revoking all other or former wills by me made, and hereby publish and declare this my last will and testament. setting my name and seal this 16th. Hiram JoslinHerkimer County, NY Surrogates Office Book - U, Page - 187 Probate Date 9/30/1881 Letters Recorded Book - I Page - 397 Submitted by Earl E. Joslin Jr. I Hiram Joslin of Frankfort NY, being aged 75 years and being of sound and disporay (sic) mind and memory, do ordain and publish this my Last Will and Testament in manner and form following that is to say. First - I order and direct all my just debts and funeral expenses be paid. Second - I give devise and bequeath unto my daughter, Evaline Orendorf of Sycamore, Illinois, now sojourning with me at my residence in Frankfort, NY, all the rest and residue of my estate, real personal and mixed of every name and nature whatever and wheresoever situated, to her and her heirs and assigns forever, subject however to the payment of the hereinafter named legacies and annuities which I hereby make charge and appoint a charge upon said residue of my estate and charge the same with the payment thereof and I hereby order and direct my daughter Evaline to pay the same out of the gifts devises and bequests heretofore made and given to her. To wit, to my daughter Mary E. Putman of Frankfort, NY, I give and bequeath the sum of two thousand dollars without interest, to be paid by my said daughter Evaline as aforesaid, at the rate of two hundred dollars each and every year until the whole two thousand dollars without interest shall have been paid. The first payment to be made at the expiration of one year from and after my decease. To my son Hamilton H. Joslin of Frankfort, I give and bequeath the sum of fifty dollars annually so long as he shall live. Said sum to be paid each and every year without anticipation to him and him only by my said daughter Evaline, as aforesaid the first payment to be made at the expiration of one year from and after my decease. And as this provision is intended for or to contribute towards his maintenance and support, and that of his wife and family during the time of his natural life, the same shall not be assignable nor subject to levy and excretion for his debts but shall be paid to him and him only and not otherwise. Lastly, I appoint my said daughter Evaline Orendorfand Perrin A. Skiff MD of Frankfort, executors of this my Last Will and Testament hereby revoking all former wills by me made. I Sanford Joslin of the town of Frankfort, Herkimer County, NY, being of sound mind and memory and knowing that I am in poor and feeble bodily health, do make publish and declare this my Last Will and Testament as follows. 1st. I give devise and bequeath to my beloved wife Saville Joslin, the use of the house in which she and I have lived for several years past, as long as she lives and she is to have her support and maintenance and the sum of $50, fifty dollars each year. 2nd. I give devise and bequeath to my beloved neice (sic) Alice G. Brock, a home and living here as long as she remains single, and the sum of $500, five hundred dollars to be paid to her in ten equal anual (sic) payments of $50, fifty dollars each. The sum that remains unpaid, after each installment has been paid, shall not bear interest and no interest is to be paid on any part of the legacy. In case of the death of said Alice G. Brock while she remains single and before any or all or any part of said $500, five hundred dollars has been paid to her then I give devise and bequeath the whole of said five hundred or that part of it that remains unpaid to my two grand children Fannie A. Joslin and Earl S. Joslin to be divided equally between them share and share alike. In case of the marriage of my neice (sic) Alice G. Brock then the said sum of five hundred dollars is to be paid to her as above provided, or to her heirs. I give devise and bequeath to my beloved son Merritt F. Joslin, all my real and personal property subject to the above mentioned legacies. I appoint my son Merritt F. Joslin sole executor of this my Last Will and Testament. S. In the matter of proving the last will and testament of Clarence V. Joslin (deceased) HERKIMER COUNTY, SS. W.H. Day of the village of Big Moose, in the county of Herkimer, State of New York and John D. Denio of the village of Big Moose, in the county of Herkimer, State of New York being each duly sworn, do depose and say, the said W.H. Day for himself that he is a subscribing witness to the last Will and Testament of Clarence V. Joslin late of the Town of Webb in said County of Herkimer, deceased; and the said John D. Denio for himself that he is a subscribing witness to the last Will and Testament of said Clarence V. Joslin late of the said Town of Webb in said County of Herkimer, deceased and that the said deceased did on the 7th day of February 1909, in the presence of these deponents, subscribe his name at the end of the instrument which is now shown to these deponents, and which purports to be the last Will and Testament of said deceased, and which bears the date 7th. Day of February 1909; that the said deceased did at the time of subscribing his name to said instrument as aforesaid, declare the same to be his last Will and Testament; and these deponents did thereupon subscribe their own names at the end of said instrument as attesting witness to the execution thereof, at the request of said deceased, and in his presence, and in the presence of each other. That said deceased at the time of subscribing his name to said instrument as aforesaid, was upwards of twenty-one years of age; that he appeared to be of sound mind and memory, and was not under restraint to the knowledge of belief of these deponents. Joslin (deceased) Satisfactory Proof by affidavit having been made and filed of the due service of the citation heretofore issued in this matter requiring the proper persons to appear in this Court on the 14th. Day of March A.D. 1910, at 10 o'clock in the forenoon, and attend the probate of the LAST WILL AND TESTAMENT OF Clarence V. Joslin late of the Town of Webb in the County of Herkimer, and state of New York, deceased, and Edward C. Rice, Esq., atty at law of Herkimer N.Y. having been appointed Special Guardian for the infants, Hazel B. Joslin, Eloise B. Joslin, Chester A. Joslin, Clarence R. Joslin, Huntington E. Joslin and Earl B. (sic) Joslin and he having filed his report herein, and the witnesses having appeared in support of the proof the said Last Will and Testament, and after hearing the proofs and allegations of the said witnesses, and the witnesses in support of the probate of the said Will, and the probate thereof not having been contested, and duly deliberating thereon, it is Adjudged and Decreed that the said Last Will and Testament was duly executed, that the same is genuine and valid, and that the said Clarence V. Joslin, deceased, at the time of executing the same, was in all respects competent to make a last Will and Testament, and to devise real estate, and was not under any restraint, and this Court doth Further Order and Decree that the said last Will and Testament and the proofs and examinations taken in respect to the same be recorded, and that the said last Will and Testament be admitted to probate, and that the same be, and hereby is, established as a Will of real and personal estate. George W. Ward Surrogate. WILL I Clarence V. Joslyn (sic) of Big Moose, County of Herkimer, State of New York, make this my last will and testament, and by it give devise, bequeath my estate and property both real and personal, as follows, my house and lot with all personal property I own situated at big Moose, Herkimer County, NY, to my wife Leola Joslyn (sic). I give bequeath and devise this my property to my wife Leola Joslyn (sic) without any instructions to hold sell or dispose of as she may see fit and without any instructions other than to pay my outstanding debts as the law requires. And I make no provisions for any of my children as I am satisfied and believe that she will provide for them as seemeth (sic) best and proper to her. I appoint my wife Leola Joslyn (sic) of Big Moose, Herkimer County, NY as sole executor of this my will, and desire that she is not required or compelled to give bonds for the execution thereof.
