To all to whom these presents shall come or may concern. Greetings.
     Know ye that I, Charles S. [or L.] BENTON, Surrogate of the County of Herkimer, pursuant to the power in me vested by the laws of this state, have this day appointed and do hereby appoint William Brooke MULLER [?] of the town of Little Falls, Special Guardian to William CORY, James CORY, John CORY, & Martha CORY [?], heirs of Burnham CORY deceased under the age of twenty one years, for the special purpose of taking care of their interests in the matters of the proving the last will, and testament of William CORY deceased, the said William BROOKE, Junior having just consented and agreed in writing to be appointed and [?] as [?] special Guardian.
     In witness whereof I have hereunto set my hand and affixed my seal of office this 28th day of December in the year of our Lord One thousand Eight hundred and thirty nine.

In the matter of the last will and testament of William CORY deceased as a will of real and personal property.
     Nathan WILLINGTON of the town of Russia in the County of Herkimer being duly sworn & examined doth depose and testify that the instrument in the hands of the Surrogate purporting to be the last will and testament of William CORY deceased and now shown to the deponent was handed to this deponent by the said William CORY in his life time - who requested deponent to keep the same in his custody. That deponent has kept the said instrument in his custody & possession constantly from the time the same was handed to him as aforesaid until after the death of the and testation which took place on the 13th day of December - last past according to deponents best recollection when deponent placed the said instrument in the hands of Almon BEECHER, who as deponent is informed, believes left the same at the office of the Surrogate of Herkimer County as proof of probate a short time thereafter and the deponent verily believes the said instrument to be the identical last will and testament of the said William CORY deceased and that the same has been in no way altered or changed since it was executed & published by the said testator.

In the matter of the last will and testament of William CORY deceased, as a will of real & personal property
     Nathan WILLINGTON of the town of Russia in the County of Herkimer being duly sworn and examined doth depose and testify that he was acquainted with William CORY (now deceased) in his life time. That this deponent saw the said William CORY subscribe the instrument now shown to the deponent purporting to be the last will and testament of the said William CORY bearing date the 10th day of October in the year Eighteen hundred and thirty five and that the said William COREY at the same time declared the said instrument to be his last will and testament and that the deponent, together with Ebenezer N. WALKER & Phebe WALKER, the other subscribing witnesses to said will, subscribed his name as a witness at the request of the said deceased and that the said will was executed by the deceased in the presence of all of said witnesses and was attested by all of said witnesses at the time it was executed and in the presence of the testator and of each other, and at the time the same was executed the deceased was of full lawful age and of sound mind & memory not under [?] to the best of the deponents' knowledge & belief.

     Ebenezer N. WALKER of the town of Russia in the County of Herkimer being duly sworn & examined doth depose & testify that he was acquainted with William COREY (now deceased) in his life time, that this deponent saw the said William COREY subscribe the instrument now shown to the deponent purporting to be the last will and testament of the said William COREY at the same time declared the said instrument to be the last will & testament, and that the deponent together with Nathan WILLINGTON & Phebe WALKER the other subscribing witnesses to said will, subscribed his name as a witness at the request of the said deceased and that the said will was executed by the deceased in the presence of all of said witnesses and was attested by all of said witnesses at the time it was executed and in the presence of the testator and of each other, and at the time the same was executed the deceased was of just lawful age and of sound mind & memory & not under restraints to the best of the deponents' knowledge & belief.

     Ebenzer N. WALKER of said county being duly sworn make the oath & attest that Phebe WALKER, one of the subscribing witnesses to said will, died on the first day of May One thousand Eight hundred and thirty seven, that said Phebe was the wife of this deponent and further that Ebenezer N. WALKER [?].
     Examined this 26th day of February 1840 before me.

WILLIAM CORY'S WILL


     In the name of God. Amen. I Wm COREY of the town of Russia, County of Herkimer, State of New York, considering the uncertainty of this mortal life being of sound mind and memory blessed be Almighty God for the [?] do make and publish this my last will and testament in [?] manner afirm [?] following that as [?] today.
     I firstly give and bequeath to my beloved wife Rachel COREY all my household furniture, also a good & comfortable [?] during her natural life or as long as she remain my widow.
     I also give and bequeath and de?? to my beloved son in law Almon BEECHER, and my daughter Elizabeth his wife, their heirs and assigns, all that my mesenage or testament situated lying in the town of Russia County aforesaid, together with all my other household estate whatsoever, to hold to their [?] the said Almon BEECHER and Elizabeth his wife, their heirs & assigns, proven on the condition that they or their heirs executors or administrators pay or cause to be paid to my beloved children the legacies as follow, that is to say, my son Wm COREY and my daughters Martha NEWBERRY, Synthia GREANFIELD, Freelove FENNER, Lyton WOODDING, one hundred and eighty dollars to each of them payable in four equal anuel allotments, the first installments to be paid at the expiration of one year after my decease, and also to pay to my son Burnham COREY ten Dollars, and further to fulfil the bequest before made to my beloved wife.
     And lastly, as to the remainder of my personal estate, goods & chattels, of whatsoever kind, I will that it be equally divided amongst all my children after paying my funeral charges and settling my debts and [?].
     I appoint Almon BEECHER my sole Executor of this my last will and testament herein by revoking all former wills by me made.
     In witness whereof I have hereunto set my hand and seal this 10th day of October A.D. One thousand Eight hundred and thirty five N. B., the words eight interlined before I sined.

     Be it remembered that on the twenty sixth day of February in the year of our Lord one thousand Eight hundred and forty the above last will and testament of William CORY deceased was committed to probate & duly proved as a will of personal property, and probate thereof was thereupon granted & at the same time said will was duly proved as a will of real property upon & by the oaths rendered of Nathan WILLINGTON & Ebenezer N. WALKER of the subscribing witnesses there to [?] appearing that Phebe WALKER, the other subscribing witness, is now deceased and upon such proof & examinations it appears that said will was only executed that the testation at the time of executing the same was in all respects competent to [?] real estate and not under restraint, which will proofs and examinations so taken have been duly recorded in the proper book for that purpose provided in the Surrogates Office - L.S.
     In witness whereof I have hereunto set my hand and affixed my seal of office this 26th day of February in the year of our Lord one thousand Eight hundred and forty.

IN THE MATTER OF PROVING THE LAST WILL AND TESTAMENT OF LAVINIA CORY, DECEASED

    Isaac H. Bliss of the town of Salisbury in the county of Herkimer and Eliza Ann Bliss of the town of Salisbury in the county of Herkimer being first duly sworn in open Court, on their oaths do depose and say that they are the subscribing witnesses to the last Will and Testament of Lavinia Cory, late of the town of Salisbury in the said county of Herkimer, deceased.
     And these deponents further say that the said deceased did, in the presence of these deponents, subscribe her name at the end of the instrument which is now shown to these deponents and which purports to be the last Will and Testament of the said deceased, and which bears date on the 12th day of July A.D. 1871; that these deponents did thereupon subscribe their own names at the end of said instrument, as attesting witnesses to the execution thereof, at the request of the said deceased, and in her presence, and in the presence of each other. That the said deceased at the time of subscribing her name to said instrument as aforesaid was upwards of twenty-one years of age; that she appeared to be of sound mind and memory, and was not under restraint to the knowledge or belief of these deponents.
     Sworn, examined and subscribed, before me this 14th day of January, 1875.

WILL OF LAVINIA COREY

     In the name of God Amen! I, Lavinia Cory of the City of Utica, in the County of Oneida, being in good health and sound mind and memory, do make and ordain this to be my last Will and Testament, to-wit:
     First - (after defraying any expense incured by me in sickness or otherwise), I give and bequeath Fifty Dollars each to Delucius De Witt, Jane Price and Mary E. Yale, husband and children of my deceased Sister Betsey Dewitt.
     I give to Hattie H. Miller Twenty Dollars, a daughter of sister Ann Eliza Aldrich.
     Second I give and bequeath to each of my living sisters, Mrs. Eliza Ann Madison Bliss, Mrs. Rachel Kibby and Mrs. Harriet Bliss, One Hundred and Fifty Dollars Each.
     To Isaac Bliss, husband of my deceased sister Clarisa Bliss, Seventy Dollars for his own use.
     Also Moses Hawks, husband of my deceased sister Mary Hawks, Seventy Dollars for his own use.
     I also give to the Methodist home Missionary Society Ten Dollars and Sabbath School Library at the Center Ten Dollars.
     I also give to the Methodist Sabbath School Library at Deveraux Ten Dollars. Also to the Baptist Sunday School at Deveraux Ten Dollars for Books.
     Lastly, should anything remain after defraying Funeral charges and purchasing a white marble Tom Stone to be erected soon after my decease and before the division of Property is made, will be divided between my living Sisters.
     I hereby appoint Moses Hawks of Salisbury, Herkimer County, and Lyman Barns of Salisbury, Herkimer County, Executors of this my last will and testament.
     I direct them that should my Estate at the time of my Decease fall short of the aggregate of the sums above bequeath, they shall then give to each of the several persons named above an equitable proportion. My money is not to be distributed until there is a good Tom Stone erected at my grave.

     Be It Remembered, That on the 14th day of January A. D. 1875, the last Will and Testament of Lavinia Cory late of the town of Salisbury, in said County of Herkimer, deceased, bearing date the12th day of July A. D. 1871, being the annexed written instrument, was duly proved before AMOS H. PRESCOTT, Surrogate of said County of Herkimer, according to law, as and for the last Will and Testament of the real and personal estate of said deceased which said last Will and Testament and the proofs and examination taken thereon, are recorded in this office in Book Q of Wills, on page 309 and following.
     In Testimony Whereof, I, AMOS H. PRESCOTT, Surrogate of said County, [L.S.] have hereunto set my hand and seal of Office, at the Surrogate's office in the village of Herkimer, this 14th of January A. D., 1875.
