In the matter of proving the last Will and Testament of JOHN STROUGH, deceased.

PETER J. QUEECHEL of the town of Manheim in the county of Herkimer and HIRAM BROAT of the town of Manheim in the county of Herkimer being first duly sworn in open Court, on their oaths do depose and say that they are the subscribing witnesses to the last Will and Testament of JOHN STROUGH late of the town of Manheim in the said county of Herkimer, deceased. And these deponents further say that the said deceased did, in the presence of these deponents subscribe his name at the end of the instrument which is now shown to these deponents and which purports to be the said deceased, and which bears date on the 4th day of March, A.D. 1870; that the said deceased did at the time of subscribing his name to said instrument as aforesaid, declare the same to be his last Will and Testament; that these deponents did there upon subscribe their own names at the end of said instrument, as attesting witnesses to the execution thereof, at the request of the said deceased, and in his presence, and in the presence of each other. That the said deceased at the time of subscribing his name to said instrument as aforesaid was upwards of twenty-one years of age; that he appeared to be of sound mind and memory, and was not under restraint to the knowledge or belief of these deponents.

County of Herkimer - Surrogates Court - In the matter of proving the codicil to the lst Will and Testament of JOHN STROUGH, deceased, Herkimer County SS:

HIRAM BROAT of the town of Manheim in the county of Herkimer and PETER M. BIDLEMAN of the town of Manheim in the county of Herkimer being first duly sworn in open court on their oaths do deponse and say that they are the subscribing witnesses to a codicil to the last Will and Testament of JOHN STROUGH late of the town of Manheim in the said county of Herkimer,
deceased and these deponents further say that the said deceased did in the presence of these deponents subscribe his name at thereof the instrument which is now shown to these deponents and which purporte to be a codicil to the last Will and Testament of the said deceased and which bears date on the 27th day of May A.D. 1870:

that the said deceased did at the time of subscribing

his name to said instrument as aforesaid declare the same to be a codicil to his last Will and Testament; that these deponents did thereupon subscribe their own names at the end of said instrument as attending witnesses to the execution there of at the request of the said deceased and in his presence and in the presence of each other. That the said deceased at the time of subscribing his name to said instrument as afore said was upward of twenty-one and was not under restraint to the knowledge or being of these deponents.

In the name of God Amen, I JOHN STROUGH of the town of Manheim in the county of Herkimer and State of New York of the age of seventy eight years and being of sound mind and memory do make, publish and delare this my last Will and Testament in manner following that is to say;

First - I give and bequeath to my wife CATHARINE STROUGH the sum of twenty five dollars each and every year and the use of all my personal property and to be master over the same as long as she remains my widow excepting all mortgages notes and accounts and property otherside bequeathed as hereinafter mentioned.

Second - I give bequeath and devise to my son OBADIAH A. STROUGH all my real estate of every name and nature whatsoever consisting of about thirty five acres more or less being the place I live on and Hollow or Gulf lot so called to have and to hold the same to himself his heirs and assigns forever - I also give and bequeath to my son OBADIAH all my mortgages notes accounts bonds and all my money matters to have the same immediately after my death and all my personal property of whatever else it my consist of whatever name or nature after the death of my wife CATHARINE or when she should cease of being my widow.

I also make this bequeath subject to the following legacies hereinafter named to be paid by my son OBADIAH out of the foregoing bequeath and devise made.

Third - I give and bequeath to my son CHARLES W. STROUGH six hundred dollars to be paid at anytime before my death and when so paid to debar him from ever receiving any other legacy or dower whatever or otherwise to be paid immediately after my decease.

Fourth - I give and bequeath to my other sons JOHN STROUGH, JERIMIAH STROUGH, URIAH STROUGH five dollars each and to my daughters LAVINA wife of MOSES DAVIS, LUCINDA wife of JOHN P. DAVIS , IRENA wife of NELSON KLOCK and MARY wife of EDWARD MIDDLEBROOK each five dollars and to the heirs if any

daughter DIANA who was the wife of JOHN PETRIE five dollars share and share alike and to the heirs of my daughter CATHARINE who was the wife of EZRA EASTRLY five dollars share and share alike there several legacies to be paid them by my son OBADIAH one year after my decease.<BR>

Fifth - It is my desire and wishes that my wife CATHARINE shall remain and live with my son OBADIAH as long as she remains my widow. 

Lastly - I do hereby nominate and appoint my son OBADIAH STROUGH and my son-in-law JOHN P. DAVIS to be the executors of this my last Will and Testament hereby revoking all former will by me made.

In witness whereof I have hereunto set my hand and seal this fouth day of March in the year of our Lord one thousand eight hundred and seventy.

The above instrument consisting of one sheet or two pages was at the date thereof signed sealed published and declared by the said JOHN STROUGH as and for his last Will and Testament

and in the presence of us who at his request and in his presence and in the presence of each other have subscribed our names as witnesses thereto.

Codicil to my last Will and Testament

Whereas I JOHN STROUGH of Manheim Herkimer County State of New York have made my Last will and Testament in writing bearing date the fourth of March in the year one thousand eight hundred and seventy - on and by which I have given and bequeathed to my son

CHARLES W. STROUGH six hundred dollars to be paid at any time before my death and when so paid to debar him from ever receiving any other legacy or dower whatever.  This said legacy having been paid by my son OBADIAH to my son CHARLES now therefore I do by this my writing which I hereby declare to be a codicil to my said last Will and Testament  and to be taken as a part there of order and declare that my will is that only the sum of five dollars be paid to by son CHARLES W. STROUGH in full of the said legacy given and bequeathed to him and that the remainng part of the said legacy be given to my son OBADIAH STROUGH.

and lastly - It is my desire that this codicil be annexed and made a part of my last Will and Testament as aforsaid to all intents and purposes. In witness where of I have hereunto set my hand and seal this twenty seventh day of May in the year of our Lord one thousand eight hundred and seventy.
