Indenture between George Washington, George Clinton and Elias Hopkins


This 1790 century indenture between George Washington and George Clinton (first Governor of New York State) and Elias Hopkins was transcribed by Jane Dieffenbacher, Fairfield Town Historian. All spelling and punctuation has been kept as in the original document. The first of the double "esses" normally seen in documents of this age has been transcribed as the letter "f". INDENTURE BETWEEN GEORGE WASHINGTON, GEORGE CLINTON AND ELIAS HOPKINS

THIS INDENTURE Made the twenty sixth day of August in the year of our Lord One Thousand Seven Hundred and Ninety Between George Washington of the State of Virginia and George cinton of the State of New York Esquires of the one Part and Elias Hopkins of Whitestown in the County of Montgomery in the State of New York aforesaid Yeoman of the other Part. Witnefseth, that the said George Washington and George Clinton for and in consideration of the Sum of one hundred sixty three Pounds four shillings current money of the said State, to them in Hand and well and truly priced by the said Elias Hopkins at and before the ensealing and Delivery hereto, the receipt whereof they the said George Washington and George Clinton do hereby confefs and acknowledge. Have granted, bargained and sold, aliened, released and confirmed, and by these Presents. Do fully, freely and absolutely grant bargain and sell, alien, release and confirm unto said Elias Hopkins ( in the actual pofsefsion now being by Virtue a Bargain and sale to him thereof made, for one whole year, by indenture bearing Date the next before the day of the Date these Presents and by force of the Statute for the transferring of Uses into Pofsefsion) and to his heirs and afsigns. All that Lott of Land situate in Whitestown aforesaid on the South Side of the Mohawk River containing two hundred and four acres; and distinguished in the ____Deeds of Partition and map thereunto annexed of the Tract called Coxburgh of which it is a Part, by Lott Number Twenty in the Seventh Grand Divsion thereof; Which said Deeds and (Map Referenced being thereunto had) are recorded in the Secretary's Office of the State of New York aforesaid in a Book marked Crf, Deeds commencing 25 November 1791 with the Rights, and Appurtenances thereof, and the revision and revisions, remainder and remainders, rents and services of all and singular the said premises above mentioned and described, and hereby granted, and of every Part and Parcel thereof, with the Appurtenances: And also, all the estate, right, title, interest, claim and Demand whatsoever, as well in Law as in Equity, of them the said George Washington and George Cinton, of, in and to the same, and of in and to every Part and Parcel thereof, with the Appurtenances. To have and hold all and singular the said Lott of Land and Premises above mentioned and described, and hereby, granted, and every Part and Parcel thereof, with the Appurtenances unto the said Elias Hopkins his Heirs and Afsigns, to the only proper use and behoof of him the said Elias Hopkins his Heirs and Afsigns forever. And the said George Washington and George Clinton for themselves, their Heirs and Afsigns do covenant and grant to and with the said Elias Hopkins his Heirs and Afsigns that and their Heirs, the said Lott of Land and Premises above mentioned and described and hereby granted, and every Part and Parcel thereof, with the Appurtenances, in the peaceable and quiet Pofsefsion of the said Elias Hopkins his heirs and afsigns against the said George Washington and George Clinton and their Heirs and against all and every other Person and Persons whomsoever, lawfully or claiming or to claim the same, shall and will Warrant, and by these Presents for ever defend. In Witnefs whereof, the said Parties to these Presents have herewith interchangeably set their hand and Seals, the Day and Year first above written, G. Washington (L  S) Geo Clinton (L  S) Sealed and delivered in the Presence of D. Humphreys, Tobias Lear, Be it remembered that on the sixteenth Day of March in the year of our Lord one thousand seven hundred and ninety three before me John Ray one of the Masters in Chancery for the State of New York personally appeared George Clinton Esquire who acknowledged he sealed and delivered the within Indenture as his as his Voluntary Act and Deed for the uses and purposes therein mentioned. And there appearing no erazures or interlineations in the said Indenture I do allow the same to be recorded. John Ray.
