In the Matter of the Estate

           -of-

Benjamin E. Bushnell, deceased.                                

To the Surrogate of Herkimer County:

           The petition of Kenyon A. Bushnell, of the village of Little Falls, in the County of Herkimer and State of New York, respectfully shows:

           That letters of administration of the goods, credits and chattels of Benjamin E. Bushnell, deceased, late of the village of Little Falls, in the County and State aforesaid, were granted to your petitioner, by the Surrogates Court of Herkimer County, on the 14th, day of May 1891; that your petitioner duly qualified as such administrator and filed his bond as such in the said Surrogates Court upon which bond Joseph W. Baker and Peter Conyne were sureties; and that your petitioner entered upon the discharge of his duties as such administrator, and took possession of the personal estate of Benjamin E. Bushnell, deceased, as such administrator; that there are no creditors of said estate and that the only next of kin, persons entitled to share in personal estate of said deceased, are the widow of said deceased, Emily L. Bushnell, who resides at Little Falls, N.Y. and your petitioner, who is a son of said deceased and resides at Little Falls, N.Y., that after you petitioner qualified as such administrator, a last will and testament of said Benjamin E. Bushnell, deceased, was discovered and was duly presented for probate in the Surrogate's Court of Herkimer County and was duly admitted to probate therein and that Emily L. Bushnell was named as executrix in said will and after the probate of said will the said Emily L. Bushnell duly qualified as such executrix, and still is the sole executrix of said will; That the only persons interested in the estate of said deceased are your petitioner, and the said Emily L. Bushnell, widow of said deceased and the said Emily L. Bushnell, as executrix of the last will and testament of said deceased and the said Joseph W. Baker and Peter Conyne, as sureties, upon the official bond of your petitioner, as such administrator; That the said Joseph W. Baker resides at Herkimer, N.Y. and the said Peter Conyne at Little Falls, N.Y.; That all of the above persons are of full age and of sound mind; That more than twelve months have elapsed since the appointment of your petitioner, as such administrator and your petitioner is desirious (sic) of rendering an account of all his proceedings as such administrator, to the Surrogate's Court of Herkimer County and for that purpose prays that a citation, issue to all persons interested in the estate of said deceased to attend a final judicial settlement of the accounts of your petitioner as such administrator.

           Kenyon A. Bushnell being duly sworn says that he is the petitioner above name; that he has heard read the forgoing petition and knows the contents thereof that the same is true to his own knowledge except as to the matters therein stated to be alleged upon information and belief and as to those matters he believes it to be true.
