In the Matter of the Judicial Settlement

of the accounts of Kenyon A. Bushnell

As Administrator of the estate

                        of

Benjamin E. Bushnell deceased

                                                                           

  To the Surrogates's Court of Herkimer County

            The Petition of Peter A. Conyne of Little Falls N.Y. respectfully shows that Benjamin E. Bushnell who resided at Little Falls N.Y. died May 1st 1891 and that thereafter Kenyon A. Bushnell his son filed in said Court his petition duly verified alleging that the said Benjamin E. Bushnell died without leaving a last will and testament and praying that Letters of Administration be issued to him upon the personal estate of said deceased and that thereafter and upon May 13th 1891 at the request of said Kenyon your petitioner and Joseph W. Baker as sureties executed with the said Kenyon the bond required by law to be made and filed by said Kenyon as administrator which bond was in the usual form and in the amount of $5000.00 and was filed and approved by the Surrogate of said County on or about May 13th 1891 and Letters of administration were thereupon and on May 14th 1891 duly issued to said Kenyon upon the personal estate of said deceased and he thereupon entered upon the discharge of his duties as such administrator and took possession of said personal estate which your petitioner is informed and believes was of the value of $5000.00 and that your petitioner with said Baker is a surety upon said administrators official bond and has never been released thereon and is liable to be called upon to answer any default or devastavit of said administrator in the disposition of said personal estate and that as your petitioner is informed and believes the said Kenyon A. Bushnell as such administrator has never had or applied for a judicial settlement of his accounts as such in any court although more than 18 months have elapsed since said Letters of administration have been issued to him.

Wherefore your petitioner prays that a judicial settlement of the accounts of said administrator be had in this court and that said administrator be cited to show cause why he should not render and settle his account as such administrator.
