EVELINE M. RIDER
County of Herkimer Surrogates Court. In the manner of proving the last Will and
Testament of Eveline M. RIDER deceased, Herkimer County ss: John G. HARDIMAN? of
the Town of Litchfield in the County of Herkimer, Julia A. HARDIMAN? of the Town
of Litchfield in the County of Herkimer being first duly sworn in open ______ on
their oaths do depose and say that they are subscribing witnesses to the last
Will and Testament of Eveline M. RIDER late of the Town of Litchfield in the said
county of Herkimer, deceased. And their deponents further say that the said
deceased did in the presence of these deponents subscribe her name at the end of
the instrument which is now shown to these deponents which purports to be the
last Will and Testament of the said deceased which bears the date on the 21st day
of November A.D. 1867; that the said deceased did at the time of subscribing her
name to said instrument as aforesaid declare the same to be her last Will and
Testament; that these deponents did thereupon subscribe their names at the end of
said instrument as attesting witnesses to the execution thereof at the request of
the said deceased and in her presence and in the presence of each other. That
the said deceased at the time of subscribing her name to said instrument as
aforesaid was upwards of twenty on years of age, that she appeared to be of sound
mind and memory and was not under restraint to the knowledge or belief o these

WILL
Know all men by these presents that I, Eveline Miller RIDER of the Town of
Litchfield, County of Herkimer and State of New York, being in usual health and
having a sound mind and memory knowing the uncertainty of human life and desiring
to settle my worldly affairs while I have the strenth so to do, do make and
publish this, my last Will and Testament.
Having received about one thousand dollars from my
father, Samuel Miller about twenty or more years ago and being in the undisputed
possessions this day of a bond executed by Ellen M. KING which is now worth
rising of fifteen hundred dollars, which property I hold individually and
exclusively my own entirely separate and independent from the property of my
husband which property I intend to hold in this manner the remainder of my life.
Now therefore all (therefore all) the property whether real, personal or mixed,
whether it comes from the above mentioned source or from any other source, by
accumulation, will or inheritance of which I shall die possessed or to which I
shall be entitled at the time of my decease, I devise, bequeath and dispose of in
the following manner to wit.
First. My will is that all my just debts and
funeral charges shall by my executors hereinafter named be paid out my estate as
soon after my decease as shall by them be found convenient.
Second. I give to my husband M. C. RIDER and to each of my children William M. RIDER, Eliza
RIDER, Albert RIDER, John B. RIDER, Julia E. RIDER, Wheeler Irving RIDER, Ellen
M. RIDER KING, Matthew C. RIDER Jr to each one dollar to them their heirs and
assigns forever.
Third. I give to my son William M. RIDER ($250) two hundred
and fifty dollars in money to be paid by my executor as soon as convenient after
my decease by my executors hereinafter named to be for his sole use his heirs and
assigns forever.
Fourth. I give to my daughter Ellen M. RIDER KING ($250)
two hundred and fifty dollars in money to be paid by my executor as soon as
convenient after my decease for the sole use of herself, her heirs and assigns
forever.
Fifth. I give all the rest and residue of my estate except household
furniture of which I shall be possessed or to which I shall be entitled at the
time of my decease, I devise, bequeath to be equally devided between the
following persons, persons for their sole use and their heirs and assigns forever
to wit: My husband Matthew C. RIDER, Eliza RIDER, John B. RIDER, Julia E. RIDER,
Wheeler Irving RIDER, Ellen M. RIDER KING and Albert RIDER and William M. RIDER.
I give my furniture all to my three daughters before mentioned Eliza, Julia and
Ellen, the use of to remain for my husband as long as he lives.
Lastly, I do nominate and appoint Ellen M. RIDER KING and her husband, Albert S. KING, my
daughter and son-in-law to be the executors of this my last Will and Testament.
In testimony whereof I the said Eveline Miller RIDER have to this my last Will
and Testament contained only on one side of three pieces of paper ___ each ____

The above instrument of three pieces written only on one side was at the date
thereof declared to us by the testate to be her Last Will and Testament and was
subscribed to in our presence of each of us and at her request we signed our
names here to as witnesses.

date hereof the last Will and Testament of Eveline M. RIDER late of Litchfield in
the County of Herkimer deceased bearing date the 21st day of November one
thousand eight hundred and sixty seven bearing the foregoing written instrument
was duly proved before Amos H. PRESCOTT Surrogate of said county, according to
law as and for the last Will and Testament of the real and personal estate of
said deceased which __________and the proof and examinations taken________
