The Will of John Demuth of the Town of Herkimer was graciously contributed by researcher Floyd & Kathleen Cmela. Floyd and Kathleen have donated seveal other transcribed wills in the past year. Demuth is an early and important surname for the county. This particular will contains the names of ancestors of quite a few of our site visitors.

"I would like to submit the following will for Herkimer County that was transcribed from a copy of the original from the Book of Wills co.22 Vol. B, page 224-227."




The Last Will and testament includes the names of his wife Elizabeth, and John, Richard and Christian Sillebough (variable spelling includes Syllabach), Jacob G. Weber, John Bellinger, Christopher Bellinger, John Emhoff, Frances Bloodgrass and Apollos Cooper.

Will of John Demuth

In the name of God, I John Demuth of the town of Herkimer in the County of Herkimer, New York being in good health of body and of sane and desparing mind and memory devised legal for the same and being desireous to settle my worldly affairs whilst I have the strength and capacity to do so. Do make and publish this my Last Will and Testament, And First I commit my soul unto the hands of my Creator who gave it and my body to the earth to be enterred in a decent manner at the direction of my Executors herein after named. And as to such wordly estate wherewith it hath pleased God to entrust me. I depose of the same as follows, First I give grant and devise to John Sillebough and Richard Sillebough, sons of Christian Sillebough,The whole of that ------- Building and Lot I now live on the South side and adjoining the Mohawk Turnpike and said called my house sat. Secondly -I give, grant and devise to the (said) John Sillebough and Richard Sillebough all the two undivided third part of Ninty acres of Flat land adjoining the Mohawk River to be divided Northerly and southerly, the Two thirds hereby devised to be taken off ofand lying on the East side of the same. Thirdly I give, grant and devise to the said John Sillebough and Richard Sillebough all of the Two undivided third partsof all the remaining part of my said farm on the North side of the Mohawk Turnpike Road. The Two thirds also to be taken off the Easterly side of the same Northerly and Southerly to have and to hold all and every the said-----

lands, tenement and hereditements with the appertments to them John and Richard their heirs and affiens forever subject to the conditions herein ------. Fourthly, I give, grant and devise to John Emhoff all the remaining third part of the Thirty acres of Flat land adjoining the Mohawk River to be taken off of the West side of the same, Also I give, grant and devise to the said John Emhoff the remaining westerly third and remaining part of the Lot on the North side of the Mohawk Turnpike Road to have and to hold all and every part of the Land, tenements and hereiditements with the appertemies to him the said John Emhoff, his heirs and afriens forever subject to the following conditions. First it is my will and desire that my wife Elizabeth as long as she shall remain widowby my name shall and only remain and live in the mansion house now occupied by us and receive her Third part of all my real and personal property benefits and no longer. Secondly that the said Richard Sillebough shall receive schooling and instruction until he shall attain Eighteen years, the expense of the same to be charged out of all or any of the property benefits deemed or granted. And Lastly I do hereby appoint my truly friends Jacob G. Weber and Christopher Bellinger executors of this my Last Will and Testament.

The foregoing is a true copy of the Last Will and Testament of John Demuth, late of Herkimer Town and County deceased, proven this 17th. day of December 1811 by the oaths of Apollos Cooper and John Bellinger, two of the subscribing witnesses to the foregoing Will.

Be it remembered that on the 17th.Day of December 1811 personally apppeared before me Dan Chapman- Surrogate in the said County, John Bellinger and Apollos Cooper two of the subscribing witnesses to the foregoing instrument purportedly to be the Last Will and Testament of John Demuth late of Herkimer Town who being before me duly sworn,depose and say that they saw Frances Bloodgrass the other witness subscribe his name, then all of which were done in the presence of the testators and in the presence of each other and that the said testator was of a sound and desparing mind and memory and further say not.

Be it remembered that on the seventh day of December 1811 before me Dan Chapman Surrogate in and for said County personally came Jacob Weber and Christopher Bellinger executors in the aforesaid Will named were duly sworn to the execution and performance of the said Will by taking the oath of the executors as by law required and thereupon letters Testimony were granted.

( Seal)      ThePeople of the State of New York by the Grace of God Free and Independent to all Whom were present shall come and Greeting Know ye that on the 17th. Day of December 1811 before Dan Chapman-Esquire Surrogate of said County the Last Will and Testament of John Demuth late of said County deceased a true copy whereof is hereunto annexed was proved and allowed by us and the deceased having whilst he lived and at the time of his death goods, chattels and credits within this State by means whereof the proving and registering said Will and Granting Documention of said goods, chattels and credits also the ----- ------

and final discharging whereof
doth belong unto the Administration of said Goods, Chattels and Credits of the said deceased and concerning the Will is Granted unto Jacob Weber and Christopher Bellinger as executors in the said will named, they being first duly sworn well and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and ----the said Goods, Chattels and Credits and also to render a just and true account thereof where required.

In testimony hereof we have secured the seals of Office of said Surrogate to be hereunto affixed Witness
