Last Will and Testament
of Katherine Hilts
dated 23 Nov. 1901

In the Name of God, Amen;
    I, Katherine Hilts of the village of Herkimer in the County of Herkimer and State of New York, being of sound mind and memory, do make, publish and declare this my last Will and Testament, in the manner following, that is to say:

First:   I direct that all my debts and funeral expenses be paid.
Second:    I give and devise all my property and estate as follows:
    1st.   To my beloved husband Phillip M. Hilts the use of my 17 acres of Flat lands, in Herkimer N.Y. during his life time.
    2nd.   To my said husband the sum of Four hundred Dollars.
    3rd.   To Dr. Cyrus Kay of Herkimer N.Y. the sum of Four hundred Dollars and also all claims and demands I hold against him.
    4th.   To Arthur Fagan of Herkimer N. Y. the sum of Five hundred Dollars.
    5th.   To Maggie Gilrain of Herkimer N.Y. the sum of Twenty five Dollars.
    6th.   To St. Francis De Sales Church, Herkimer N.Y., the sum of Two hundred Dollars.
    7th.   To Rev. James Halpin of Herkimer N. Y. the sum of One hundred Dollars.
    8th.   All the rest residue and remainder of my property, both real and personal I give, bequeath and devise to my beloved daughter Mrs. Clara

    Lastly,  I hereby appoint my Son in law Dr. Cyrus Kay and my daughter Mrs. Clara E. Kay executors of this, my last Will and Testament: hereby revoking all former wills by me made.

    In Witness Whereof.  I have hereunto subscribed my name the 23rd day of November in the year of our Lord one thousand nine hundred and one.

We whose names are hereunto subscribed, Do Certify, that Mrs. Katherine Hilts the testatrix subscribed her name to this instrument in our presence and in the presence of each of us, and at the same time, in our presence and hearing, declared the same to be her last Will and Testament, and requested us, and each of us, to sign our names thereto as witnesses to the execution thereof, which we hereby do in the presence of the testator and of each other on the day of the date of the said Will, and write opposite our names our respective places of residence.
